Terms and conditions of submitting work to The Flaneur
(Submission Consent Form)
By clicking on the “submit” button, you agree that you have read, understood, and accept the following terms and conditions:
You agree:
that you (or your third party licensors) own all of the copyright and other intellectual property rights in any images, text or other material (“Submission”) that you submit and that you have the right to submit each such Submission for use in accordance with this agreement;
that use of any Submission within the Flaneur journal (or any journal which succeeds such journal) and any related journals or magazines, such as an annual compilation, (together, “Flaneur”) shall not infringe the copyright or any other intellectual property rights, or any other rights, of any party;
that you grant to Flaneur a non-exclusive, irrevocable, royalty-free, worldwide licence to publish, edit, modify and use each Submission within Flaneur in any media including but not limited to print, digital and electronic media, audio and audiovisual media (whether now known or hereafter developed or discovered) and in any manner at our discretion without further review, notice, approval, acknowledgement, consideration, or compensation;
that you hereby irrevocably waive in favour of us the benefit of all moral rights and performers’ rights arising under the Copyright, Designs and Patents Act 1988 or similar rights arising under the laws of any jurisdiction;
that you grant Flaneur the right to use and publish your name, photograph or likeness, and details about you within Flaneur;
that entering into this agreement does not in any way conflict with any existing commitment on your part.
We do not undertake to publish or otherwise exploit the Submission.
You agree that no Submission shall be libellous, defamatory, inflammatory or blasphemous, and that each Submission shall comply with all applicable laws.
You acknowledge that Flaneur shall not be liable for any loss, damage or injury suffered by you in connection with use of any Submission other than death or personal injury caused by our negligence or any other liability which cannot be excluded by law.
You hereby indemnify Flaneur irrevocably against any costs, claims, damages, expenses and liabilities suffered by Flaneur as a result of your breach of this agreement. The rights under this agreement may be freely assigned or licensed by Flaneur. This agreement shall be governed by and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
